TERMS OF USE AND SELLER TRANSACTION TERMS
IndianJewelryBuyers.com is operated by OC Wireless Inc., d/b/a National Jewelry Buyers, 5815 Menaul Blvd NE, Albuquerque, New Mexico 87110 — buying jewelry at this location since 2011. In these Terms, "Indian Jewelry Buyers," "National Jewelry Buyers," "we," "us," and "our" refer to OC Wireless Inc., d/b/a National Jewelry Buyers, the business operating this website and purchase service.
1. Agreement to these Terms
These Terms apply when you use IndianJewelryBuyers.com, text or email jewelry photographs or information, request or accept an offer, or ship jewelry to us. A specific transaction may also be governed by the written offer, shipping instructions, Seller Ownership Certification, and other transaction documents we provide. If those documents conflict with these general Terms, the transaction-specific written terms control.
2. Eligibility and authority to sell
You must be at least 18 years old, legally able to enter a contract, and have a physical address in the United States. You may submit or sell only jewelry that you own or are legally authorized to sell. The jewelry must be free of undisclosed liens, security interests, or competing ownership claims.
3. Website information and offers are not appraisals
Website content, educational material, estimates, and photo-based offers are provided only for considering a purchase. They are not formal appraisals, authentications, or opinions of value for insurance, tax, probate, charitable contribution, lending, or litigation. Artist, tribal, age, stone, and origin identifications may be preliminary until the jewelry is examined in person.
4. Photo submissions and communications
You may submit photographs, descriptions, contact information, and related records by text message, email, website form, or another method we approve. You represent that the information is accurate and that you have permission to send the photographs. You give us a limited permission to use submitted materials to evaluate the jewelry, communicate with you, maintain transaction records, prevent fraud, and comply with law.
5. Offers
Unless an offer states otherwise, it is valid for seven days and applies only to the items shown and described. We generally make one offer for the submitted items as a group and do not provide per-item appraisals or price breakdowns. Requesting an offer is free and does not obligate you to sell. Before shipment, we may correct or withdraw an offer because of a material error, suspected fraud, a legal issue, or new information showing that the items are materially different from what was represented.
6. Accepting an offer
You may accept an offer in the manner stated in it, including by replying "I ACCEPT," signing the Seller Ownership Certification, or completing another acceptance method we provide. By accepting, you confirm that you meet the eligibility and ownership requirements and agree to the transaction documents. Acceptance remains subject to our in-person inspection after delivery.
7. Shipping and insurance
If we authorize shipment, we provide a prepaid label and carrier instructions. You must use that label, pack the jewelry securely, obtain a carrier acceptance scan or receipt, and retain the tracking information. Any shipping insurance is subject to the coverage amount stated for the shipment and the carrier's packaging, exclusions, documentation, and claim rules. Using another label, an unapproved carrier, or inadequate packaging may affect coverage.
8. Inspection, revised offers, and returns
After receipt, we compare the jewelry with the photographs, description, and accepted offer. If it materially matches, we will complete the purchase. If an item is missing, materially different, ineligible, counterfeit, altered, or has undisclosed damage, we may decline the transaction or make a revised offer. We may offer to purchase qualifying items and return others, but we will not complete a sale at a revised amount without your approval. If you decline a revised offer, we return the jewelry at our expense, fully insured, unless a legal hold applies.
9. Payment and final sale
If the jewelry passes inspection and all required information is complete, we generally issue payment within one business day after receipt. Available methods may include company check, PayPal, or secure ACH, as stated in the transaction documents. Payment is issued only to the verified seller. Mail delivery and third-party processing times may vary. The sale becomes final when payment is issued.
10. Cancellation, legal holds, and compliance
You may request cancellation before payment is issued, but we cannot guarantee interception while a package is in transit or after inspection or payment processing has begun. We may request identification or other verification; retain and report transaction records; and pause, refuse, or cancel a transaction when reasonably necessary for fraud prevention, suspected stolen property, disputed ownership, carrier investigation, court order, law-enforcement request, or legal compliance.
11. Package documentation and carrier claims
For security and recordkeeping, we may photograph the unopened package, packaging, jewelry, and inspection. If a package appears damaged, opened, incomplete, or different from the transaction record, we may contact you and the carrier. Transit-loss or damage claims are subject to the applicable carrier and insurance procedures, documentation requirements, and deadlines.
12. Prohibited website use and intellectual property
You may not interfere with the website, introduce malicious code, misrepresent your identity or ownership, attempt fraud, submit unlawful material, or violate another person's rights. The website's text, branding, graphics, layout, and original content are owned by or licensed to us and may not be copied, republished, or commercially used without written permission. You retain ownership of photographs you submit, subject to the limited permission stated above.
13. Third-party services and links
We may use or link to third-party services, including website hosting, communications, carriers, insurers, payment providers, maps, analytics, advertising measurement, and social media. Their services are governed by their own terms and privacy practices. We are not responsible for third-party websites or services we do not control.
14. Availability and discretion
We may change, suspend, or discontinue any part of the website or purchase service. We are not required to make an offer, accept jewelry, or complete a transaction when legal, operational, authenticity, condition, market, ownership, security, or compliance concerns arise.
15. Disclaimers and limitation of liability
To the fullest extent permitted by law, the website and services are provided without warranties not expressly stated in writing, and we are not liable for indirect, incidental, special, punitive, or consequential damages. For a seller transaction, our liability for loss of or damage to jewelry after confirmed delivery to us will not exceed the accepted offer amount, except where a different remedy is required by law or the loss results from our gross negligence or intentional misconduct. Nothing in these Terms limits rights that cannot legally be waived.
16. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain effective. The affected provision will be enforced or modified only to the minimum extent necessary to make it valid and enforceable.
17. Governing law and venue
These Terms are governed by New Mexico law, without regard to conflict-of-law principles. Any court action arising from these Terms or a transaction must be filed in a court with jurisdiction in Bernalillo County, New Mexico, unless applicable law requires otherwise.
18. Changes to these Terms
We may update these Terms by posting a revised version and effective date. The version provided or available when you accept a specific offer will govern that transaction unless both sides agree otherwise in writing.
19. Text messaging (SMS/MMS) terms
When you text photographs or a message to 505-549-1411, you consent to receive text messages from Indian Jewelry Buyers (OC Wireless Inc., d/b/a National Jewelry Buyers) in reply to your request, including questions about your jewelry, our cash offer, shipping instructions, and payment or return updates. Message frequency varies with your conversation. Message and data rates may apply. Reply STOP at any time to opt out. You will receive one confirmation message and no further texts unless you opt back in by texting START. Reply HELP for help, or contact us at 505-888-1807 or offers@indianjewelrybuyers.com. Consent to receive texts is not a condition of selling to us; you may use email or visit in person instead. Carriers are not liable for delayed or undelivered messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
